Terms and Conditions (Valid 15 May 2006 – 31 March 2007)

1. General

• This agreement and its interpretation shall be subject to District Court Jalore , Rajasthan, India.

• All reservations will be on a pre-payment basis. Should payment not be received timely, Siana Camps & Safaris reserves the right to automatically cancel such reserved accommodation.

• All rates apply to both group and FIT reservations, and are quoted per person per night. Siana Camps & Safaris reserves the right to amend the published rates without notice.

• Check-in time is 12h00 and check-out time is 11h00. Any variations on these times must be advised prior to guests' arrival at the camps and any variations are at the sole discretion of the camp manager.

2. Children's Policy Siana Camps & Safaris:

• Children under 16 years shall be permitted, if accompanied by family member and are experienced and competent riders, and the party they are traveling with have reserved the safari exclusively.

3. Reservation Policy

• No reservation is secure/confirmed until a 50 % deposit is received to secure the booking. Siana Camps & Safaris reserves the right to automatically release accommodation being held unless a deposit is received within the stated period for each reservation.

• Siana Camps & Safaris reserves the right to charge the following cancellation fee should a confirmed reservation be cancelled within the following period: -5% cancellation fee if cancelled less than 60 days prior to arrival. 25% cancellation fee if cancelled less than 30 days prior to arrival. 50% cancellation fee if cancelled less than 7 days prior to arrival. 100% cancellation fee if cancelled 24 hours prior to arrival or no show.

• All guests shall settle their extras accounts in full prior to departure from the camps.

4. Cancellations

• Cancellation fees are calculated on the full rack rate per person.

• Should cancelled accommodation be resold, cancellation fees will be refunded less a 5% handling charge.

• Please ensure that your clients are covered by a travel insurance policy to offset unforeseen cancellation.

• All reservation amendments or cancellations are valid only if advised and accepted in writing, by facsimile or e-mail.

5. Important Notes

• Failure on the part of the Agent to comply timely or at all with any of the Terms and Conditions herein contained shall entitle Siana Camps & Safaris, in its sole discretion, regardless of reservation requirements and/or payments already received, to cancel/refuse to accept the Agent's reservation in respect of group/s or individual/s in question, unless satisfactory alternative arrangements are made by the Agent.

• It is to be noted that this agreement is between Siana Camps & Safaris and the Agent or FIT . The Agent or FIT shall therefore not be entitled to any leniency or indulgence in the event of the group/s or individual/s not timely performing their corresponding duties to the Agent.

• Please note that should Siana Camps & Safaris receive a firm, deposited booking over the dates when the Agent is holding space and prior to the agent forwarding the necessary deposits to secure the reservation, the Agent will be requested to release the space he/she is holding, or to forward an immediate non-refundable deposit on all space held, to secure the space.

• This agreement shall endure in respect of reservations made for the period 15/05/06 to 31/03/07.

6. Payment Details

• Siana Camps & Safari : Pre-payment as per the above mentioned conditions via bank draft payable in to:- Siana Camps & Safaris. Payable at Jodhpur , Rajasthan, India. • Full pre-payment of accommodation and transfers should be received a minimum of 30 days prior to the client's arrival.

• Payments must be received by Siana Camps & Safaris on the dates stipulated. Delays in postal services and mislaid payments are the responsibility of the Agent.

• Cheques are not accepted at any of the camps.

7. Variation/ Waiver

• No refunds are granted for an early departure from a safari.

• Siana Camps & Safaris reserves the right to make use of any photographic material taken on safari by staff or agents. Agents accept that compensation for this use, for marketing/advertising purposes, shall be at the discretion of the company only.

• Siana Camps & Safaris reserves the right to dismount any rider, who in the guide's opinion, is unable to control his/ her horse or who poses a threat to the safety of himself/ herself or to other riders in the group.

• Siana Camps & Safaris reserves the right to judge a rider's competence. The company does not cater for beginner riders. It is an advantage to be fit and know the basic aids before doing our trails. You should be confident at the rising trot and canter. Information required in advance of the safari includes the guest's name, age, height, weight, riding experience in detail and any special diets, medical aid name and number, a traveling insurance reference number, contact name and number of next-of-kin.

• Variation or waiver of the above Terms and Conditions is at the sole discretion of Siana Camps & Safari.

• All reservations accepted by Siana Camps & Safaris are subject to the above terms and conditions AND an indemnity form to be signed by participants on arrival.
